NAIROBI, 15th Oct 2026 -The Ethics and Anti-Corruption Commission (EACC) has welcomed a High Court judgment that has sustained the corruption conviction of former Kiambu Governor Ferdinand Waititu and reinstated money laundering charges against him and his co-accused.
Delivering judgment on 14th October 2026, Justice Rose Ougo of the High Court Anti-Corruption and Economic Crimes Division upheld the conviction of Waititu, his spouse Susan Wangari Ndungu, former Chief Officer for Roads Luka Mwangi Wahinya and Testimony Enterprises director Charles Chege Mbuthia.
Justice Ougo also set aside their acquittal by the trial court on money laundering charges – a ruling EACC termed crucial in tracing illicit financial flows.
The prosecution stems from 2019 investigations into the irregular award of a Sh588 million roads upgrade tender to Testimony Enterprises Limited during the 2017/2018 financial year. The contract involved gravelling and tarmacking roads in Thika, Limuru, Gatundu North, Juja and Ruiru.
The four were first convicted on 12th February 2025 on charges of conflict of interest, abuse of office, dealing with suspect property, fraudulent procurement and wilful breach of procurement laws.
In a related asset recovery suit, the Anti-Corruption Court in December 2025 ordered Waititu and his associates to forfeit assets worth Sh131.2 million. These included Thindigua properties valued at Sh64 million, a Sh11 million Caterpillar excavator, two vehicles, Sh3 million property linked to his wife and Sh52 million property linked to Saika Two Estate Developers Ltd.
EACC is further pursuing a civil recovery case of Sh70 million against Waititu and Testimony Enterprises, which is still pending in court.
Mitigation and sentencing on the reinstated money laundering counts will be heard on 19th October 2026 before the Anti-Corruption Magistrate’s Court.
